Was the 2020 Election Stolen from Donald Trump?

Let’s consider the evidence carefully and honestly.

If you are a Trump voter who is beginning to doubt the results, that is not irrational. People are allowed to ask hard questions about election integrity. But a fair-minded inquiry should ask a simple question: is there evidence that is strong enough to overturn the result? On the record, the answer appears to be no.

What the Evidence Actually Shows

The Heritage Foundation has documented more than 1,500 individual cases of election fraud between 1982 and 2024. Many of those cases led to convictions. But it is important to note that fraud is not the same as a stolen election. Election fraud can happen in isolated cases without changing the outcome of a presidential race. [Heritage]

Fox News aired claims that Dominion Voting Systems' machines had been rigged to steal the election from Donald Trump. Dominion sued Fox News for defamation. Internal documents released during pre-trial discovery showed that top executives at Fox knew those claims were false. Fox News did not present evidence that the machines were rigged and settled the case for $787 million. [Wikipedia]

Rudy Giuliani claimed that a video showed two election workers in Georgia cheating and scanning ballots multiple times. The two women received death threats. They sued Giuliani, who admitted that his statements were false. A jury awarded the election workers $148 million. [NPR]

The film 2000 Mules claimed to show Mark Andrews illegally voting multiple times by mail. The Georgia Bureau of Investigations found that he was mailing ballots for family members, which is legal. Mr. Andrews later filed a defamation lawsuit against Salem Media, the publisher of the film. Salem settled the lawsuit and issued an apology to Mr. Andrews. They also stopped distribution of the film and book. [Salem] [NPR] [Wikipedia]

The Arizona recount: The Arizona Senate hired Cyber Ninjas, a pro-Trump organization, to recount the state’s 2020 ballots. The recount was demanded by and paid for by Trump supporters. Cyber Ninjas ultimately concluded that Biden won the Arizona election and found an additional 361 votes for Biden. [NPR] [Wikipedia]

The Trump campaign filed 62 lawsuits related to alleged 2020 election fraud. Nearly all of them were dismissed for lack of evidence or lack of standing. Many dismissals came from judges appointed by Donald Trump and other Republican presidents. The campaign won one case related to voter identification, but that decision was later overturned by the Pennsylvania Supreme Court. [Reuters] [Wikipedia] [CLC] [ElectionIntegrity]

Donald Trump has claimed that it was statistically impossible for Biden to have won in 2020. Those claims were reviewed by Stanford professor Justin Grimmer, who works at the conservative Hoover Institution. He found that the claims failed to provide evidence of fraud or illegal voting. In December 2020, Trump’s own attorney general, William Barr, stated that the Department of Justice had found no evidence of widespread voter fraud that would have changed the outcome of the election. [Axios] [PBS video]

Republican officials refused to overturn the results in their states despite intense pressure. Georgia’s Secretary of State Brad Raffensperger and Arizona House Speaker Rusty Bowers, both Republicans, defended the integrity of their states’ election processes. What a Serious Skeptic Should Ask

A fair-minded skeptic should look for evidence that is:

When those standards are applied, many claims of election fraud fail. That does not mean fraud never happens. It means the burden of proof is high, and the evidence in 2020 did not meet it.

Swing State Results

The 2020 result in the swing states: There is some evidence of fraud by individual actors, but not enough to change the results in the key states. Biden won those states by significant margins. Biden won the Electoral College 306 to 232. [Wikipedia]

State Electoral College Biden Trump Margin for Biden
Arizona 11 1,672,143 1,661,686 10,457
Georgia 16 2,473,633 2,461,854 11,779
Michigan 16 2,804,040 2,649,852 154,188
Nevada 6 703,486 669,890 33,596
Pennsylvania 20 3,458,229 3,377,674 80,555
Wisconsin 10 1,630,866 1,610,184 20,682

Conclusion

The American electoral system did not work perfectly, but the evidence indicates that it worked as designed in 2020. Trump filed lawsuits, the evidence was reviewed by judges, including conservative judges, and recounts were conducted. If there had been strong evidence of fraud, it would have had to be introduced under oath in those legal proceedings.

The overall record shows that the 2020 election results were not overturned because the available evidence did not meet the legal and factual standard required to do so.

If you know of factual evidence that contradicts this conclusion, please share it on Discourse.
